Welcome to CodePlay! These Terms of Service (“Terms”) govern your use of our website, courses, and services. By accessing or using our platform, you agree to comply with these Terms.
1. Acceptance of Terms
By using CodePlay, you agree to these Terms. If you do not agree, please do not use our services.
2. Business Registration & Compliance
CodePlay LLC is a U.S.-registered EdTech company operating internationally. While we provide online educational services globally, if you are accessing our services from the United States, you acknowledge that CodePlay complies with relevant U.S. laws, including federal and state regulations applicable to online education businesses. Our services are subject to U.S. tax laws, consumer protection regulations, and industry-specific compliance standards.
3. Eligibility
You must be at least 18 years old to purchase our services. If you are under 18, a parent or legal guardian must complete the purchase and provide consent for your participation. For children under 13 years old, we require verifiable parental consent before collecting any personal information, in compliance with the Children’s Online Privacy Protection Act (COPPA).
4. Accessing Our Services
Our courses and services are available for purchase without requiring an account. When purchasing a course, you must provide accurate payment and contact details. It is your responsibility to keep proof of purchase and any access credentials we provide.
4. Payment and Refund Policy
4.1 Payment Terms
All purchases must be completed using the payment methods available on our platform. Prices are listed in U.S. dollars and may be subject to applicable taxes, duties, or processing fees based on your location and applicable laws. By making a purchase, you agree to provide accurate payment information and authorize us to charge your selected payment method. Users will not be automatically charged after their initial payment unless they manually purchase another course.
4.2 Refund & Cancellation Policy
We strive to ensure customer satisfaction with our courses. However, refunds are granted only under the following conditions:
- Technical Issues: If you experience technical issues preventing access to the course and we cannot resolve them within a reasonable time frame.
- Duplicate Purchase: If you accidentally purchase the same course more than once, we will refund the duplicate charge.
- Service Not Delivered: If CodePlay fails to provide access to a purchased course within the specified timeframe, a refund may be issued.
4.3 Non-Refundable Cases
Refunds will not be granted under the following conditions:
- Failure to complete a course or lack of engagement.
- Change of mind or personal preference.
- Inability to meet technical requirements on the user’s end (e.g., device compatibility, internet access).
- If the refund request is made after 7 working days from the date of purchase.
4.4 Refund Request Process
To request a refund, you must:
- Contact us at codeplay@edugamers.co with your order details.
- Provide a reason for the refund request.
- Allow up to 3 business days for us to review and respond. If a refund is approved, it will be processed back to the original payment method within 7 business days.
5. Use of Services
You agree to use our courses for personal learning and not for commercial resale. Any misuse may lead to restricted access.
6. Privacy, Child Safety & Data Protection
CodePlay stores user data on secure servers. In some cases, we may process data outside of the U.S. in compliance with international privacy laws. We do not sell user data to third parties, but we may share necessary information with service providers (e.g., payment processors, analytics tools) to operate our platform.
6.1. Age Restrictions & Parental Consent
- CodePlay’s services are designed for children aged 5-18, but only parents or legal guardians may create an account and enroll a child in a course.
- If the user is under 13, verifiable parental consent is required before participation, in compliance with the Children’s Online Privacy Protection Act (COPPA). If you reside in California, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to request data access, deletion, or opt-out of data collection. By using our services, you consent to the transfer of your data to our international servers, in accordance with applicable GDPR and U.S. privacy laws.
6.2. User Identity & Prohibited Misrepresentation
- Users must provide accurate information during registration.
- Adults may not impersonate a child to access courses designed for minors.
- If CodePlay discovers any misrepresentation, we reserve the right to suspend or terminate the account without a refund.
6.3. Live Class Participation & Monitoring
- Parents/guardians must ensure their child is the one attending the class under the registered account.
- CodePlay may implement camera verification or other security measures to confirm child participation.
- Private messaging between students and instructors is strictly prohibited outside of supervised class interactions.
6.4. Parental Responsibility & Advisory Notice
- While CodePlay takes measures to create a safe learning environment, parents/guardians remain responsible for monitoring their child’s participation.
- Parents are encouraged to:
- Supervise their child’s online sessions.
- Report any suspicious activity to CodePlay immediately.
6.5. Reporting & Account Termination
- Any user suspected of violating child safety policies will be investigated and may be permanently banned from CodePlay.
- If CodePlay determines that a user has engaged in inappropriate behavior, we reserve the right to report incidents to law enforcement.
7. Intellectual Property
All course content, trademarks, and branding remain the property of CodePlay. You may not copy, distribute, or reproduce our materials without permission.
8. Code of Conduct
Users must follow ethical behavior guidelines. Any form of harassment, hacking, or abuse will lead to immediate termination of access.
Users are expected to maintain respectful and professional behavior in all interactions within CodePlay’s courses and services. The following behaviors are strictly prohibited:
- Use of offensive, abusive, or discriminatory language
- Bullying, harassment, or intimidation of other students or instructors
- Disruptive behavior that interferes with the learning experience of others
- Sharing or posting inappropriate content during live sessions or in chat discussions
CodePlay reserves the right to immediately suspend or terminate a user’s access if they violate these behavior policies.
9. Accessibility & Compliance
CodePlay is committed to ensuring that our platform is accessible to all users, including those with disabilities. We strive to comply with the Americans with Disabilities Act (ADA) by providing features such as screen reader compatibility, closed captions for video content, and alternative text for images. 10. Limitation of Liability
CodePlay is not responsible for any indirect, incidental, or consequential damages arising from the use of our services. This includes, but is not limited to, lost profits, data loss, or service interruptions. While we strive to provide uninterrupted access, we do not guarantee that our courses or website will be available at all times. CodePlay’s total liability for any claim shall not exceed the amount paid for the disputed service.
10. Termination
We reserve the right to suspend or terminate access to services if users violate these Terms. CodePlay reserves the right to suspend or permanently terminate a user’s access to our services if they violate the Code of Conduct outlined in Section 8. This includes, but is not limited to, the use of offensive language, bullying, harassment, or any behavior that disrupts the learning environment. Termination due to behavioral violations will not be eligible for refunds.
11. Dispute Resolution & Jurisdiction
All disputes shall be resolved through arbitration in the State of Wyoming, USA, unless another jurisdiction is required by law.
You may opt out of this arbitration agreement by sending a written request to codeplay@edugamers.co within 30 days of agreeing to these Terms. Opting out of arbitration will not affect your ability to use CodePlay’s services.
